One in three Americans have hypertension. Chances of developin g hypertension increases with age. Hypertension does not only occur in adults, it also occurs in children. Hypertension is classified by three different types: Primary Hypertension, Secondary Hypertension and Complicated Hypertension (Staff, High Blood Pressure). Secondary Hypertension is caused by an underlying disease, ex. Kidney problems, adrenal gland tumors. Complicated Hypertension is brought on once Hypertension becomes severe and chronic and can cause tissue damage and target organ damage (Staff, High Blood Pressure). After getting my clinical placement, my role as a student nurse was associated with many challenges, however these challenges gave me the opportunity to learn and develop as a registered nurse. This reflective essay describes my experience related to a clinical scenario that I faced in my clinical placement. The reflection will be done using the Taylors reflect model to describe the case scenario and the challenges that I faced while caring for the patient. Taylors model of reflections will help me as a nurse to critically reflect on the challenges I faced, how I overcame them and what I learnt from the experience that helped me to develop as Registered nurse. The practical reflection approach is selected to describe what happened and how my role affected the patient. Evidence also suggests that reflective learning related to delivery of nursing care enhances the knowledge and skills of registered nurse. It makes them aware of their own values in nursing and develop nursing plan accordingly in the future to deliver patient-centered care (Vikstrm et al., 2015). Taylors REFLECT model of reflection is based on the following aspects- Readiness, Exercising thought, Following systematic processes, Leaving oneself open to answer, Enfolding insight, Changing awareness and Tenacity in reflection. My readiness to reflect comes from my commitment to continuously learn and enhance my nursing competencies by reflecting on past experiences and taking lessons from them. I am going to exercise my thought by describing lived experience of a clinical situation that I faced in my clinical placement (Taylor, 2014). By the process of practical reflection, re-experiencing questions describes my clinical scenario. During my clinical placement, I came across a deteriorating patient who had been admitted to the emergency department with an overdose. At that time I was newly placed in the hospital as a student nurse and my role was to be with the preceptor who had the responsibility for maintaining the airway of the patients. I was informed by my preceptor that such patients with drug overdose develops seizures, circulatory collapse and they also have the risk of dying. Acute intoxication also leads to respiratory depression, slurred speech, pulmonary edema, coma and death (Zhang et al., 2016). Hence, the first immediate step for the nurse in this situation was to insert the endotracheal tube as precautionary measures and use assisted ventilation to stabilize the patients (Bolen, 2016). My preceptor ordered me to go to the resuscitation area and assist the senior nurse. As I had never been to the res uscitation area before, I was very nervous. I had no idea about how the patients are incubated and what equipments are needed for the process. When I was put into this situation, I realized my lack of nursing skills in the area of maintaining airway potency. I was not aware of the equipments required for intubation and I knew that I will have a hard time assisting the senior nurse. Based on reinterpretation of the situation where I encountered the deteriorating patients in the resuscitation room, my hope was that I will try my best to assist the nurse and make no delay in my actions to prevent any harm to patients. I was aware of my nursing values of being accountable and fair to the patients and use my expertise to safe guard health and well-being of patients (Iacobucci et al., 2013). In the resuscitation rooms, a physician was overseeing the patient and asked the senior nurse to arrange the equipments for intubation quickly. The patients condition was deteriorating and intubation either with endotracheal tube or tracheostomy might solve airway complications in the patient. I was given a checklist of intubation equipment which I had to provide to the nurse as fast as possible. It mainly included equipments like endotracheal tube, laryngoscope, face mask, bag valve mask, oxygen source, cardiac monitor, IV kit, stethoscope, lubricating gel, syringes and batterie s (Bean et al., 2016). I was familiar with some of the equipments and the airway trolley. Finally I decided to communicate this to my senior nurse as for me patients safety was my first priority and did not wanted to cause any harm to patients because of my lack of knowledge. I told her that I am not familiar with many of the equipment. She immediately understood and told me this is normal at this stage as I had just been newly placed at the hospital. Hence, I at least managed to achieve my communicative role and avoided any confusion or risky situation in the clinical setting (Williams et al., 2016). I was highly relieved by the nurse comment; however I resolved that I will ask about the equipments and its use from my preceptor after my end of shift. Earlier I had the perception that physicians only play a role in the intubation process, however after assisting the nurse, came to learn that nurses also play a vital role in management of patients in the resuscitation room (Schneiderhahn Fish, 2014). I observed the senior nurse and stepwise process she performed as part of preparation for intubation. She oxygenated the patient using the bag valve mask and attached the patient to a pulse oximeter (Hatch et al., 2016). Another observation by me was that professional nurses and other health care staffs delegate task efficiently so that everyone is aware of their role in the process and the medical intervention takes place at a rapid rate (Valentine, Nembhard, Edmondson, 2015). The senior nurse instructed me to position the patient. However this was not simple, the patient had to pos ition according the height of the bed so the physicians get a comfortable position to insert the tube. Other responsibilities were to prepare and administer sedative medications which I did and I had no problem in this because I had done this earlier during my nursing education. During the preparation for the intubation process, I was clueless most of the time regarding why certain equipments are being prepared. I wanted to get back to my preceptor to learn about the equipment as soon as possible (Prekker et al., 2014). At this stage, all the preparation related laryngoscope and battery check was done. Finally the physicians placed the endotracheal tube accurately and the senior nurses attached the patient to ventilator as per physcians order. I thought this is the end of the process and my responsibility. However, the senior nurse interrupted me and told me that nursing management after the patient is intubated is very crucial. She was constantly giving me new knowledge and I was feeling empowered after being aware of different nursing responsibilities to manage airway problems. The reflection about the above scenario and my experience at the resuscitation room taught me many lessons. It was a form of relearning for me even after my completion of nursing education. I realized that whatever knowledge so far I have garnered as part of my nursing education is not enough and my real learning and professional development will start when I will face real patients in clinical setting. I was at least confident after this experience that next time I will not struggle during the intubation process. I learnt that even after inserting the tube, nurses need to constantly monitor the patients. For example they need to assess the clients respirator status every 2 hours and assess their nasal mucosa for any redness or irritation. Secondly, they need to close monitor the cuff pressure of patients to minimize any risk of tracheal necrosis. Patients under intubation also have risk of oral infection, so nurse has the responsibility to provide oral care after every 4 hours (Sole Bennett, 2014). Another most important lesson that I learnt about airway management and care of such patient was that we should communicate frequently with such patient. As they cannot speak, they should be given communication aids such as white board so that we can understand their issues and build a therapeutic relation with them. Furthermore, after my shift time, I cleared all my doubts regarding the use of different equipment and airway trolley tube from my preceptor. Now I was confident that this knowledge will come in handy during the airway management of patients coming in the emergency room in the future. As part of my ethical responsibility, I will also ensure that I will perform all my nursing responsibility in accordance with the current standard of nursing practice and hospitals protocol. Hence, airway management is a skill dependent on knowledge of airway anatomy, equipments for airway manipulation and judicious use of pharmacological agents. I am also sure that my nursing skills will i mprove by experience and more time spent in clinical setting (Lewis et al., 2015). Too, adventure travel can enlighten your soul à and even help save the world . Can you think of anything else that can do all that? Ten Reasons Why Adventure Travel Is Good for You 1) When you get dirty, you improve your physical health. Scientists have recently reported that our modern obsession with cleanliness might be leading to a rise in allergies, asthma, and inflammatory bowel disease. Getting dirty could just be the best path to developing a strong immune system. Going on adventures means getting dirty ââ¬â and healthier. à Outdoor activities can prevent (or treat) a wide range of health problems. Doctors around the country are now handing out ââ¬Å"park prescriptionsâ⬠for conditions ranging from heart disease to obesity to attention deficit disorder. Adventure travel takes park prescriptions to the next level. 3) There are no age limits on adventure. Anyone can make nature a playground. Adventure travel is an activity you can stick with for life. Take a hike, get a bigger brain. Research indicates that hiking or walking grows brains. Typically, your hippocampus gets smaller once you hit your mid fifties, leading to memory loss. But a group of middle-aged adults that took three, forty-minute walks a week for a year grew their hippocampi, on average, by 2 percent, which could improve their retention for years. So, what is the positive and negative impact? As far as I concerned, the first advantage staying in a foreign country is that people can make a lot of friends. Once you land your foot at that place, you will have a new atmosphere. Everybody that you see and meet is unfamiliar for you. In my experience, when I had my vacation to Singapore, I have made a lot of fellows because I meet a lot of new people there. The second advantage is the chance to improve your language. Socializing can enhance your knowledge. For example, Tuti, my best friend, who is studying in Canada. Firstly, she doesnt have good English knowledge and pronunciation. But after studying there for two years, her English is improving fastly. Except that, people can learn cultures from locals. Each country has various cultures. For example, I have a friend who came from England to Indonesia, my country. He told me that he have learned many things after his visit to Indonesia. Except the advantages that we can get, there are also having the disadvantages. People need to spend a lot of money especially for living place. The cost of living can be higher because you need to pay for staying in an apartment or in boarding house. For example, my father spends a lot of Ringgits when he visited Malaysia, because he was staying at a hotel. But, it will be lucky if you have any relative that you know and you can stay in their house. Another disadvantage is a person need to take care everything by oneself especially for health. To sum up, staying in foreign country is like an adventure for me, even though there are some disadvantages that I dont like. So, when I to staying in overseas, all that I must think about is all the advantages. Staying in a new place is interesting right? Just try it! Mendacity vs Truth in Cat on a Hot Tin Roof
Tennessee Williamsââ¬â¢ book Cat on a Hot Tin Roof takes place entirely in the plantation home of the Pollitt family in the Mississippi Delta. The plantation once belonged to a pair of bachelors, and ââ¬Å"Big Daddyâ⬠Pollitt had worked for them as an overseer, but he is now the owner of the plantation, which he has built into a dynastic empire. Big Daddyââ¬â¢s family has met at the house to celebrate his birthday. Maggie, a beautiful and witty girl, has escaped a childhood of poverty to marry into the wealthy Pollitt family, but finds herself in an unfulfilling marriage. She is married to Big Daddyââ¬â¢s son, Brick. He is an aging football hero, and constantly neglects his wife. Brick further infuriates her by ignoring his brother's attempts to gain control of the family fortune once Big Daddy passes away. Brick's coldness towards Maggie and his alcoholism can be attributed to the death of his best friend, Skipper. Big Daddy has been feeling a bit under the weather, and what he believes is a spastic colon ends up being a form of cancer. Big Daddy is unaware that of his illness and that he doesnââ¬â¢t have much time left to live, so his doctors and his family have conspired to keep this information from him. The web of lies that is spun throughout this book is huge, spanning nearly every member of the family. Big Daddy comments on it towards the end of the book after he is told the truth by Brick, as he questions ââ¬Å"Whatââ¬â¢s that smell in the room? Didnââ¬â¢t you notice the powerful and obnoxious odor of mendacity? â⬠According to Big Daddy, ââ¬Å"Mendacity is one of them five-dollar words that cheap politicians throw back and forth at each other. The dictionary definition tells us that mendacity is a falsehood, a lie, or a tendency to be untruthful. Mendacity is seen throughout the play and is a negative effect on the characters. All the characters are affected, but some are impacted more than others. Those greatly affected are Brick, Maggie, Big Daddy, and Gooper. The whole ââ¬Å"lie vs. truthsâ⬠plays a crucial role in developing the storyline and plot structure of the novel. As I previously mentioned, Brick was always very cold towards Maggie, elling at her and even attempting to hit her with his crutch. The very fact that Brick uses a crutch to walk is symbolic, in that the alcohol was his crutch to deal with Skipper's death. Skipper and Brick have a great friendship, and it can almost be viewed as homosexual. The fact that Skipper killed himself the night after he played in a football game without Brick and had many fumbles and played very poorly overall. Maggie states that ââ¬Å"it was only Skipper that harbored even any unconscious desire for anything not perfectly pure between you too! (Williams, 833) Brick believes Maggie is the reason that Skipper killed himself, because she was ruining their friendship. Brick mourns his love for Skipper, which was the only true and good thing in his life. Maggie never dares speak of the forbidden love, and therefore Big Daddy is forced to step in as the judge. When Big Daddy confronts Brick about the homosexual attraction between himself and Skipper, Brick becomes extremely defensive and explains how their friendship was nothing more than a pure and true friendship. Big Daddy presses the issue, and Brick can no longer lie about the cause of Skipperââ¬â¢s death. It is then revealed at the climax of the book that before Skipper took his own life, he called Brick long distance and drunkenly confessed his love to him, finally removing the weight of the lie that was Skipperââ¬â¢s life, pretending that him and Brick were heterosexual friends. Brick however, didnââ¬â¢t say a word, and just hung up. This ended up being the last time Brick ever heard Skipperââ¬â¢s voice, and because of this, Brick drinks heavily to deal with the pain of taking his best friends life. This moment in the book is very impactful for it is one of the only times that mendacity isnââ¬â¢t in the air, as Brick and Big Daddy are being real with each other, with no veil of lies to hide behind, perfectly put as Big Daddy says, ââ¬Å"then there is at least two people that never lied to each other. â⬠The big deception throughout the play is that of Big Daddyââ¬â¢s health. The entire family and the Doctor are all in on this, and each person becomes split into 2 or 3 individuals because of all the deceit. Big Daddyââ¬â¢s other son Gooper and his wife Mae are both guilty of mendacity. To Big Daddy and Big Mommaââ¬â¢s faces, they put on the guise as loving people, when in fact it is all an attempt to get Big Daddy to sign over the land and money to them in his will. They constantly bring up that they have children while Maggie and Brick donââ¬â¢t, and that Brick is an alcoholic. Basically pointing out all the flaws of their ââ¬Å"competitionâ⬠to try and better themselves in Big Daddyââ¬â¢s eyes. Big Mama lies to herself by thinking that a child from Maggie and Brick would turn Brick into a non-drinking, family man qualified to take over the family place. Big Mama had to have been distraught by the fact that her husband has less than a year left to live, and is being lied to by his entire family, talking on how he will live forever and people toasting to his health. Big Daddy is even wrapped up in the mendacity, as he admits to Brick during their heart-to-heart that everyday of his life is consumed with lies, as he pretends to like Gooper and Mae, but when in reality, he cannot stand them. Big Daddy never loved Gooper, but only desired for him to be successful and have a family. Gooper, in attempt to gain Big Daddy's love, he always did what he thought Big Daddy would have wanted for him, like having children and becoming a lawyer. The two never talk about their lack of relationship, as Gooper only tries to win Big Daddy's love, but Big Daddy never listens to him. Therefore because of this mendacity Gooper does not care about Big Daddy's affection, as I previously mentioned, his main intention is to inherit his land. Their relationship is filled with lies because they never talk about their lack of a relationship, which makes the relationship worse. One of the most important relationships in the book is that of Brick and Maggie. Throughout the entire novel, their conversations are mostly them fighting with each other, and it seems they are a married couple, in name only. Their relationship is based on lies and filled with mendacity, which tears them apart. Maggie lies to Brick and tells him that she and Skipper had an affair, because she was afraid that he was going to steal her husband away. The aforementioned homosexual love affair between Brick and Skipper caused a great deal of turmoil throughout the house. The biggest lie in the entire book comes at the very end of the novel, in which Maggie proclaims to Big Daddy that she is pregnant with Brickââ¬â¢s child. Big Daddy is overjoyed by this news, and decides to put Brick down as the sole beneficiary to the land. The final scene involves Maggie and Brick in the bedroom, with Maggie locking the door and telling Brick that tonight they were going to ââ¬Å"make the lie true. â⬠The false reality that Maggie created by lying will soon to come to fruition and all will be good in the Pollitt household. Brick ends the play by responding to Maggieââ¬â¢s profession of love with ââ¬Å"Wouldnââ¬â¢t it be funny if that were trueâ⬠¦? â⬠Although Brick sounds confused at her words, but he may simply be assuming that because he had been indifferent towards her, she must also be that way towards him. The lies and mendacity of the entire Pollitt family nearly tear the very structure of their being apart, but in the end, the lies end up creating a better reality, one in that Brick and Big Daddy have come to terms with each other, and Maggie the Cat is finally going to be a mother (assuming her and Brick went through with the sexual conception. Mendacity has caused the Maggie to become much more than just a cat on a hot tin roof, she is now the sole light in Big Daddyââ¬â¢s life, for heââ¬â¢s long awaited for grandchild is finally on the way, and the rekindling of her and Brickââ¬â¢s relationship ends the book on a feel good note. Itââ¬â¢s somewhat ironic that after all the pain and suffering caused by the lies, that the happy ending is a product of the biggest lie of them all.

Group projects in college can be great experiences or nightmares. From other people not carrying their weight to waiting to the last minute, group projects can quickly turn into an unnecessarily large and ugly problem. By following the basic tips below, however, you can work to ensure that your group project leads to a great grade instead of a massive headache. Set Roles and Goals Early It may seem silly and basic, but setting roles and goals early will help out immensely as the project progresses. Specify who is doing what, with as much detail as possible and with dates and deadlines when appropriate. After all, knowing that one of your group members is going to complete part of the papers research wont do any good if he completes it after the project due date. Allow a Time Cushion at the End of Your Schedule Lets say the project is due on the 10th of the month. Aim to have everything done by the 5th or the 7th, just to be safe. After all, life happens: people get sick, files get lost, group members flake. Allowing for a little cushion will help prevent major stress (and a possible catastrophe) on the actual due date. Arrange for Periodic Check-ins and Updates You may be working your you-know-what off to finish your part of the project, but not everyone may be as diligent. Arrange to meet as a group every other week to update each other, discuss how the project is going, or even just work on things together. This way, everyone will know the group, as a whole, is on track before it becomes too late to fix the problem. Allow Time for Someone to Check the Final Project With so many people working on a project, things can often seem disconnected or confusing. Question: Discus about the Court of Law for Legally Enforceable Contract. Answer: 1. It is very important to understand the meaning of a legally enforceable contract and the various elements of a contract before answering the said questions. When an agreement is entered into between two or more parties by an offer and acceptance and which can be enforced in the court of law for any kind of breach is termed as a legally enforceable contract in the eyes of the statute. There are various kinds of contracts that exist such as a construction contract, lease agreement, employment contract etc. An agreement is said to be entered into once an offer is made by the offeror and the same is duly accepted in exchange of a consideration by the offeree. Further to this, an agreement to be in written form is not necessary, thus verbal agreements also construe as a legally enforceable contract except in some situations where a written agreement is a must (Arthur, 2015). The most essential part of a contract is existence of a valid and sufficient consideration. Consideration is basically exchange of something that is valuable for both the contracting parties, thus it has to be in monetary terms is not necessary. As long as there exist a mutual benefit, consideration is said to be present. Lastly the fact that the agreement is to be performed immediately as soon as it is entered is a myth. The mere act of performance or promise to act in future also construes as a valid contract. In the first instance Jane offers his car to Jack before departing overseas. The said offer is duly accepted by Jack without any further negotiations. The market value of the car is known to both the contracting parties to be $25000. But however, the said phrase of consideration is not mentioned in clear terms by Jane while offering her car, neither the mode of receiving payment nor any such other details which would enable one to construe the same as a legally enforceable contract. In such situations also, even if there is no explicit mentioning of the consideration amount yet it is viewed as a valid agreement due to its nature of an implied contract wherein even if the amount is not mentioned specifically yet the same is expected that Jack is to pay Jane $25000 at the time of delivery of the car. On a careful analysis of the said situation it is understood that four major elements of a valid contract is duly present. An offer- made by Jane to Jack, an acceptance- by Jack (Denicola, 2002) , Contract is duly bound by the statute, consideration in the form of a market value. Therefore the fact that the said situation is very condemnatory in nature yet after reviewing the entire situation in detail it can be concluded that a consideration is present. The second scenario is a very crystal clear case. Here Jack while offering her car to Jane clearly mentions th amount of consideration i.e. $25000 and due to the presence of all the four elements of a contract it can be concluded that the said contract is a legally enforceable one. First and foremost Jane makes a clear cut offer to Jack for selling her car without any uncertainty. The said offer is accepted in its true sense by Jack, though verbally but not forcefully. Thirdly the said contract is legally binding upon both Jack and Jane of the state in which the contract has been entered into and lastly there exists a sufficient consideration of $25000. Thus presence of all the four elements of a contract is easily identifiable in the said situation (Rembert, 1997). Legally a consideration is defined as a benefit which should be negotiated between the contracting parties before deciding at the same. It is an essential part of any valid contract and is exchanged either on the performance of an act or a promise to perform an act in future. Consideration should be adequate in nature. Sufficiency is the key for a valid consideration. Thus if the amount of consideration is viewed as unfair i.e. it is either insufficient or overtly priced, in both the stances consideration is not acceptable (Giancaspro, 2014). Furtherance to the this, the amount of consideration should be finalized upon after due deliberations and negotiations so that both the parties tend to gain, thus not causing detriment to any of the two contracting parties. There may arrive some circumstances wherein it would seem that the amount of consideration offered is unfair. There may be various causes such as lack of awareness of the fair price for the contract or any kind of force or coercion to name a few. In such situations the other party should try to disclose the same so that the agreement is not unfair and is entered in good faith, else the court of law would intervene to resolve the said issue (Valente, 2010). In the present scenario there does not exist any element of oppression or force on behalf of any party. Further the consideration may not be adequate but it is sufficient thus acceptable in legal parlance. Thirdly Jane is very well versed with the fair value of the car but still makes an offer for just $2500. This is her decision and right and thus nobody can intervene or question upon the same. However Jack should make an effort from his side to ensure that Jane is aware of the difference in consideration of the actual market value of the car and the value offered by her (Gordon, 1990). Thus the court of law cannot intervene in the said case as there does not exist any malafide intention on the part of both the parties to the contract. There the consideration is a valid one. 2. Agreement drafting is a very critical part while entering into a construction contract. The nature of a construction contract is ambiguous and thus the concept of implied doesnt apply here. Therefore in simple terms, a construction contracts agreement should be drafted in a manner which states all the clauses in details with regards the legal implications of the non-performance of the contract, the exchange fluctuation clause, escalation clause, and how are the contracting parties rights protected in case of breach of contract (Construction Industry Council. 2011). However although the concept of implied does not hold good in case of construction contract yet there are some clauses which automatically become applicable due to its unavoidable nature. Thus an perfect contract is one which clearly defines the rights, duties and the obligation of the contracting parties. This enables to protect them from any kind of breaches and provides solutions in case of possible conflicts. Where the contracting parties reside in two different countries with different currencies, inclusion of an exchange fluctuation clause is a must otherwise the contract would be construed as a fixed price contract. Projects with a long gestation period is the most affected due to fluctuation in currencies thus this clause aims to protect the seller or the builder in case of major fluctuations. Therefore for the seller to claim for fluctuation, the same should be mentioned in the contract agreement else the builder has not rights to halt the construction and claim for the increase. However the same can be done in case there is a mutual consent of the two parties to the contract (Arthur, 2015). The present scenario states about a contract that was entered into between a ship builder and North Ocean Tankers and that the contract consideration was to be given in dollars. The contract failed to mention any clause with regards fluctuation in the currency. But due to devaluation of the currency by 10 percent the builder seemed to suffer a loss. Hence to recover the same he asked the buyer to either pay him the exchange difference else he would stop the construction of the tanker. The buyer who had already taken a charter for the said tanker could not afford to let the same happen so agreed to pay the same and got the delivery of the tanker well on time. Now after nine months of delivery the buyer seeks remedy for the breach of contract by the seller. The said contract was a fixed price contract due to unavailability of the fluctuation clause in the contract agreement (Wilson, 2007). The price to be paid to the seller was clearly mentioned and therefore the contract was not liable to pay any exchange difference which would arise due to fluctuation. Unfortunately the buyer was in a dilemma in the said scenario because he had already taken a charter and he would have to suffer monetary as well as reputational loss if the tanker was not delivered on time by the contractor. Thus under undue pressure he agreed to the terms statd by the contractor and paid the difference and the contract was fulfilled on time and the buyer took the delivery of the tanker. Thus this is a case of mutual resolution even though a breach was conducted by the builder. The very concept of breach of contract got defeated as soon as North Ocean tankers paid to the demand made by the ship builder. But the situation would have been different if the buyer had not resorted to the demand of the ship builder and taken an action against his undue and illegal demand at the that particular point of time. He would have succeeded i a case was filed against the ship builder. He would have had dual benefit if a legal case would have been initiated (Caldwell, 2012). The seller would have had no option but to compensate the buyer for any loss that he would have had suffered due to such a demand and breach. But in this case the builder took advantage of the situation knowing very well that the buyer had already taken the charter and hence was in need of the tanker. The next important point to understand is that the damage could be claimed if the breach of contract was bought to the notice of the legal authorities at the time of occurrence of the same. However, it is to be understood that the said stance is flexible and not universal. The plaintiff may be protected in some exceptional situations. But for the same, the plaintiff has to prove that he has performed his part of the contract and there is no breach from his side. The present scenario seems to be difficult to be in favour of the buyer since considerable time has lapsed and he had resorted to his demand. An ideal situation would have been one where the buyer would not have paid to the seller and filed a suit against the seller for breach of contract to seek remedy(Kinlan, Roukema, 2011). This would have helped him to enter into a mutual consent with him wherein the loss would have been borne mutually by them. The shipbuilder performed his part of the contract on time without any delay so that the buyer doesnt suffer losses. Thus in the eyes of the law the builder has not breached the contract and demanding for a price revision due to currency fluctuations on good faith is not an illegal act. Had the buyer approached the court at the time of occurrence of the breach then the same would have been resolved through arbitration. On analysing the situation in depth it seems to be a difficult affair for the buyer to seek for a remedy specially when the tanker has already been on board for nine months now. Maximum that the buyer can ask for by filing a suit is the loss he had suffered due to fulfilling of the demand of price revision (Curtis, 2012). The merger is a part of the strategic management that allows the companies to expand, alter or bring out innovation in the nature of the business and enhance the competitive position of the companies. Elliot West, the owner of Abacus decided to create an alliance with the productive firm for which it found Synergies appropriate. However, Elliot being an uneducated entrepreneur depended on the management team for the decision-making and other activities in the organisation. With the decision of merging, Elliot seemed to face certain problems regarding the effect on the employees. As Synergis was not enough centralised and the employees of Abacus had given abundant power to its employees, the company was in the risk of facing problems related to gaining control on the merged entity. In order to deal with the problem, the management team of Abacus developed a containment plan that they planned to implement after the accomplishing of the merging (McLennan, 2013). The containment plan development is the process that Abacus tries to follow in order to identify the internal and external problems faced by the company. In the meeting with Alan and Bill, when Elliot knew about the false information that Nick had been providing to him, he decided to plan another alternative containment plan. Elliot remained silent about the secret containment plan from Nick and on the other hand, he kept planning about implementing the containment plan with Nick. At the correct moment, Elliot used the strategy to disclose to Nick that the new CEO of the company would be Allan. Thus with the effective strategy, Elliot was able to take up an appropriate step towards freeing himself and the company from the influence of Nick. 2: In the case study, Abacus seemed to use more tactics and strategies than Synergies before the merging of both the companies. On the very beginning, when the companies decided to merge the business with each other, Nick mentioned to Elliot that the company needs to design certain strategies that will help them to achieve successful control over the merging of the firms. Thus based on the advice of Nick, Elliot accepted to plan a containment plan that would be implemented after the merging of the business. However, on the other hand Alan and Bill were concerned about the implementation of the containment plan by Abacus. Synergis were concerned as the implementation of containment plan by the managers of Abacus would result in the decrease in the power of Bill. The containment plan of Abacus intended to replace the senior staff of Synergies by the middle managers of Abacus. This would benefit Abacus, as the cost of merging for the company would be reduced. Therefore, Abacus decided to implement the containment strategy plan after the merging of the companies in order to gain competitive advantage over Synergis. After hearing the implementation plan, Bill and Alan met with Elliot to enquire and discuss about the plan. In the meeting, Elliot further became aware that Nick had been planning strategies against Elliot to claim the higher position of CEO in the company. In order to save the company from the negative influence of Nick, Elliot took on foot decision to combine with the owners and managers of Synergis in order to plan an alternative containment plan (Goethals et al., 2013). From the detailed study of the case, it can be opined that the strategy used by Elliot had been more successful. He had been able to achieve the appropriate outcome for the merging of the companies. Keeping the alternative plan secret from Nick minimised the risk, as Nick was incapable of planning other strategy to reach his objectives. 3: The company uses both legitimate and illegitimate political behaviour within the workplace. By legitimate political behaviour in the organisation, it refers to the daily politics that takes place within the company. On the other hand, the illegitimate political behaviour is the power and leadership within the organisation. In case of this situation both, the legitimate and illegitimate political behaviour has been simultaneously used in the companies. In Abacus there has been presence of legitimate political behaviour as Nick, the managing manager of had been providing false information to Elliot, the owner of the company. Since, Elliot was not well educated, he completely relied on Nick. Taking the opportunity, Nick tried to carry out politics that could help him to achieve the higher position in the organisation. Although, Nick recommended Elliot to develop a containment plan for the time after the merging so that the an effective control can be achieved, he was successful in convincing the staffs of Abacus that he has been the driving force of the company and had more importance than Elliot (Lasswell, 2013). Thus, this can be considered as one of the legitimate political behaviour in the organisation. The leaders of Synergis of cooperative with each other they try to consult each other before making any organisational decisions (Frohlich Oppenheimer, 2015). As per the case study, Bill tried to understand the issues faced by Al an because of the merging decision with Abacus. Both the companies discussed in the case study are different from each other in context of political behaviour. As in Abacus politics play a significant role that influence the outcomes of the organisation, there is legitimacy political behaviour identified in the organisation (Dowse, 2013). Synergis on the other side perform open and widespread politics. A number of factors are present in the organisation that influences the political behaviour of both the organisation. Factors such as individual factors, organisational factors add to the presence of political behaviour (Ainsworth, 2014). Thus, after the merging of the company it can be stated that that Synabis will be having both legitimate and illegitimate political behaviour in the company simultaneously. 4: Alan implements the democratic leadership style in Synergis that helps the company to achieve the organisational goals. The democratic leadership is also known as the participative leadership that allows the employees and other members of the organisation to participate in the organisational activities and the decision-making of the company (Beck Cowan, 2014) Alan has been able to gain popularity and respect within the organisation, as he has been a passionate believer in making clear and transparent communication with the employee and the management. Alan further implements up-front management style. This management style makes Alan easily approachable to the employees (Gold et al., 2013). The employees are satisfied with the management as they are sure that whatever the decision be, Alan would stand beside them. Further, the leadership style used by Alan helps the employees to participate in the decision-making. Alan is therefore able to increase the effectiveness of the decision-making process with the help of the democratic leadership. The employee satisfaction level is also enhanced, as the employees are able to effectively participate in delivering high organisational performance (Chhokar, Brodbeck House, 2013). The capabilities, skills and knowledge of the employees are utilised to the maximum level. Alan uses the leadership style to identify the individual capabilities of the employees. Among the several leadership theories, the most effective theory that could be applied to Alan is the contingency theory. The contingency theory in the organisation claims that there is no specific best way for the company in order to lead the organisation. The effectiveness of the leaders depends upon the particular situation faced by the leaders (Daft, 2014). This gives rise to two factors such as the leadership style and situational favourableness. Moreover, two leadership styles can be outlined from the contingency theory namely task-motivated and relationship-motivated leadership. With the implementation of the contingency model in the organisation, Alan would be able to achieve a number of advantages such as choosing the appropriate and effective leaders for the organisation who will be able to guide the employees in the right direction. Alan will further be able to use the model as a tool to build up groups by altering the variables present in the organisation. A wealth of mat erials is present with the leader while implementing the contingency theory (Dooley, 2014). Nevertheless, if Alan uses the contingency model of leadership in the organisation, the model will allow ballpark results that are flexible in nature. The flexibility allows the leaders to achieve a wide range of effective relationship between the management and the employees. Merging of the companies require effective leadership as the leaders need to manage the perception of the employees of both the companies.
